20 States Accuse Generic Drug Companies of Price Fixing

A wide-ranging investigation into generic drug prices took its most significant turn yet on Thursday, as state attorneys general accused two industry leaders, Teva Pharmaceuticals and Mylan, and four smaller companies of engaging in brazen price-fixing schemes - and promised that more charges were coming. A civil complaint filed by 20 states accuses the companies of conspiring to artificially inflate prices on an antibiotic and a diabetes drug, with executives coordinating through informal industry gatherings and personal calls and text messages. Officials said the case was a small example of broader problems in the drug business. “We believe that this is just the tip of the iceberg,” George C. Jepsen, Connecticut’s attorney general, whose office started the inquiry that led to the charges, said. “I stress that our investigation is continuing, and it goes way beyond the two drugs in this lawsuit, and it involves many more companies than are in this lawsuit.” The complaint on Thursday describes a cozy industry culture defined by regular dinners and social outings, and argues that those events often cross the line to violate antitrust rules. Generic drug makers hoping to begin selling a new drug first seek out rivals, the suit says, in hopes of reaching an agreement on how to maintain market share and avoid competing on price. “These agreements had the effect of artificially maintaining high prices for a large number of generic drugs and creating an appearance of competition when in fact none existed,” the lawsuit says.

Feds Arrest 6 Former Insys Execs for Allegedly Bribing Doctors

FBI agents arrested former Insys Therapeutics CEO Michael Babich and five other former company executives on Thursday for allegedly bribing doctors to prescribe an extremely addictive opioid painkiller to patients who didn’t need it. The Department of Justice (DOJ) alleges that the executives took part in a “nationwide conspiracy” to give healthcare providers kickbacks in exchange for the improper prescribing of Subsys - an opioid medication containing the highly addictive substance fentanyl, which is considered even more dangerous than painkillers like Vicodin. Subsys is meant to provide pain relief to cancer patients who are going through particularly excruciating pain episodes. It’s reserved for these neediest of patients due to its potency and addictive qualities. But federal prosecutors allege that Babich and his co-conspirators doled out kickbacks to doctors who prescribed the drug even to non-cancer patients, and even set up a special “reimbursement unit” to sway insurance companies and pharmacy benefits managers to provide coverage for these non-authorized uses. The charges range from racketeering to conspiracy to mail and wire fraud. The FBI’s actions come in the wake of a newly invigorated federal effort to tackle the prescription painkiller epidemic, which has claimed the lives of more than 165,000 Americans since 1999.

The watchdog wing of Congress has quietly launched an investigation into the “integrity” of the Pentagon’s whistleblower protection program. The Government Accountability Office, which serves as the investigative arm of Congress, has been looking into the extent to which Department of Defense whistleblower policies ... reassure employees of their rights to raise concerns “without fear of reprisal.” The investigation will also likely target senior Pentagon officials accused of destroying evidence that would have exculpated former senior NSA official Thomas Drake, who raised internal complaints about what he believed to be NSA misconduct and waste before ultimately approaching journalists. Rather than having his concerns acknowledged, Drake spent months fighting charges against him under the Espionage Act. His career in the intelligence community was ended. “Bureaucratic abuses of power are the primary reason otherwise circumspect national security whistleblowers leak to the media. It is too dangerous to work within an untrustworthy system,” Tom Devine, legal director of the Government Accountability Project, wrote in a statement. John Crane, formerly the assistant inspector general in the Pentagon, revealed his role in attempting to protect Drake’s identity and investigate the document destruction involved in his case last May - an effort he claims cost him his job. The latest batch of President-elect Donald Trump’s Cabinet nominees are poised to reshape not only the nation, but also the planet. The man tapped to be America’s chief diplomat is a trusted friend of Russia, the nation’s longtime geopolitical rival. The man tapped to lead the Department of Energy has long pledged to kill it. Russia [awarded him] its Order of Friendship in 2013, one of the highest awards Moscow gives foreigners. The man nominated to shepherd the Labor Department opposes raising the minimum wage. And Trump’s nominees to run the Environmental Protection Agency and the departments of Interior and Energy are dubious about the science behind climate change. Trump tapped these men — most of his nominees are wealthy, white men — because they are top “deal-makers.” And while they may not be creatures of Washington, they are still part of the nation’s elite and a far cry from Trump’s campaign promise to “drain the swamp” of entrenched power-brokers. “It’s a cabinet of tycoons,” said Eleni Kounalakis, a San Francisco business executive who served as U.S. ambassador to Hungary from 2010 to 2013. “He believes business tycoons know what’s best. Like what’s best for Exxon is best for America.”

An inquiry into child sex abuse claims involving ex-Prime Minister Sir Edward Heath is exploring a "significant number" of lines, police say. Wiltshire Police Chief Constable Mike Veale ... said officers had received "allegations spanning a significant number of individuals". It emerged last month that two people had been arrested and bailed. Former Conservative prime minister Sir Edward died at his home in Salisbury in July 2005, aged 89. In an open letter, Mr Veale said he would not be "buckling under pressure to not investigate or to conclude the investigation prematurely". He said he wanted to "set the record straight" amid press reports the inquiry was floundering. "The decision to undertake this ... investigation was not taken lightly particularly knowing, or at least expecting, that we would be placed under intense scrutiny," he said. Mr Veale also confirmed reports that satanic ritual sex abuse was a feature of the investigation, although he said it was a small part and did not relate to Sir Edward. Operation Conifer began in 2015 after claims against Sir Edward were raised in an inquiry by the Independent Police Complaints Commission.

UK football sex abuse: 83 suspects and 98 clubs involved in inquiry

There are now 83 potential suspects and 98 teams involved in the inquiry into historic child sexual abuse in English football, the National Police Chiefs' Council revealed. The investigation involves all levels of football, from top-level clubs to amateur teams. Police forces across the UK continue to receive calls from victims and people offering information. In total, 639 referrals have been received from both the NSPCC (National Society for the Prevention of Cruelty to Children) helpline and police forces. Of the victims identified so far, 98% are male and their ages range from seven to 20. "Allegations received by police forces across the country are being swiftly acted upon," said Chief Constable Simon Bailey, the NPCC's lead for Child Protection. The investigation began when former professional footballer Andy Woodward became the first to publicly tell his story in November. Fellow lower-league player Steve Walters and ex-England internationals Paul Stewart and David White also came forward soon after, before a hotline was set up for people who were sexually abused while playing football in Britain.

Wells Fargo is conducting itself like Enron did

San Francisco’s Wells Fargo set up an incentivized system of rewards and punishments for its staff at every level that led to the creation of phony accounts and illicit fees being charged to millions of customers. Yet Wells Fargo ... refused to appear before my state Senate committee last month and has sidestepped federal regulators and inquiries. The last company to conduct itself in such a way before a California legislative committee was Enron. These criminal activities affected up to 2 million accounts - nearly 900,000 in California alone. The financial cost to consumers was in the millions of dollars, and the loss in trust is untold. Wells Fargo knew it had a problem - firing more than 1,000 employees a year for five years is testament to that. Yet, it took no effective steps to stop the fraud. These weren’t just low-level employees. After my staff pressed them, Wells now says that of the 5,300 staff fired for unethical sales practices, 480 were bank branch managers or higher. An untold number of managers continue to work at the bank despite the fact that they engaged in fraudulent behavior. Wells Fargo has begun to make amends by entering into a settlement agreement with local and federal regulators, paying $185 million in fines. It also has retained an outside accounting firm to audit accounts to identify and fully reimburse every customer for any fees associated with an unauthorized account. Wells Fargo must come clean on how pervasive this scheme was.

When Healey issued subpoenas seeking ExxonMobil’s documents on climate change dating to the 1970s, she was “abusing the power of government to silence a speaker she disfavors,” lawyers for ExxonMobil wrote in their June lawsuit against her, alleging a violation of the company’s rights. And they criticized the stories that prompted the investigation: Reports published in 2015 ... suggested ExxonMobil had encouraged climate change confusion for years, despite its own research documenting the risks.

But he got knocked sideways when British police officers banged on the front door of his home ... and informed him that they had “received information about forbidden images” in his possession. He faced five charges of making indecent images of children, five charges of possession of indecent images of children and one charge of possession of a prohibited image. After Mr. Bukovsky, 73, entered a not-guilty plea, [the case] was delayed [following] a prosecution request for more time to review an independent forensic report on what had been found on Mr. Bukovsky’s computers and how an unidentified third party had probably put it there. Mr. Bukovsky ... insisted that he was the victim of a new and particularly noxious form of an old K.G.B. dirty trick known as kompromat, the fabrication and planting of compromising or illegal material. Old-style kompromat featured ... a wide range of other primitive entrapment techniques. Today, however, kompromat has become allied with the more sophisticated tricks of cybermischief-making. Hacking is not only a good way to get real information ... but a relatively easy and usually untraceable way to plant fake information. The sugar industry paid scientists in the 1960s to play down the link between sugar and heart disease and promote saturated fat as the culprit instead, newly released historical documents show. The internal sugar industry documents ... published Monday in JAMA Internal Medicine, suggest that five decades of research into the role of nutrition and heart disease, including many of today’s dietary recommendations, may have been largely shaped by the sugar industry. A trade group called the Sugar Research Foundation ... paid three Harvard scientists the equivalent of about $50,000 in today’s dollars to publish a 1967 review of research on sugar, fat and heart disease. The studies used in the review were handpicked by the sugar group, and the article, which was published in the prestigious New England Journal of Medicine, minimized the link between sugar and heart health and cast aspersions on the role of saturated fat. The food industry has continued to influence nutrition science. For many decades, health officials encouraged Americans to reduce their fat intake, which led many people to consume low-fat, high-sugar foods that some experts now blame for fueling the obesity crisis. Today, the saturated fat warnings remain a cornerstone of the government’s dietary guidelines, though in recent years the American Heart Association, the World Health Organization and other health authorities have also begun to warn that too much added sugar may increase cardiovascular disease risk.

Nutrition for sale: How Kellogg worked with 'independent experts' to tout cereal

On its website, Kellogg touted a distinguished-sounding "Breakfast Council" of "independent experts" who helped guide its nutritional efforts. Nowhere did it say this: The maker of Froot Loops and Frosted Flakes paid the experts and fed them talking points. The company paid the experts an average of $13,000 a year, prohibited them from offering media services for products "competitive or negative to cereal" and required them to engage in "nutrition influencer outreach" on social media or with colleagues, and report back on their efforts. For Kellogg, the breakfast council - in existence between 2011 and this year - deftly blurred the lines between cereal promotion and impartial nutrition guidance. The company used the council to teach a continuing education class for dietitians, publish an academic paper on breakfast, and try to influence the government's dietary guidelines. One of the breakfast council's most notable achievements was publishing a paper defining a "quality breakfast" in a nutrition journal. Kellogg touted the paper in its newsletter as being written by "our independent nutrition experts." Dietitians could earn continuing education credits from the publisher for taking a quiz about the paper. Kellogg didn't describe its own role in overseeing editing and providing feedback, such as asking for the removal of a line saying a recommendation that added sugar be limited to 25 percent of calories might be "too high."

Native Americans conducted a forgiveness ceremony with U.S. veterans at the Standing Rock casino, giving the veterans an opportunity to atone for military actions conducted against Natives throughout history. In celebration of Standing Rock protesters’ victory [towards] halting construction on the Dakota Access Pipeline, Leonard Crow Dog formally forgave Wes Clark Jr., the son of retired U.S. Army general and former supreme commander at NATO, Wesley Clark Sr.. Salon published Clark’s apology to the Natives, which read as follows: "Many of us, me particularly, are from the units that have hurt you over the many years. We came. We fought you. We took your land. We signed treaties that we broke. We stole minerals from your sacred hills. We blasted the faces of our presidents onto your sacred mountain. When we took still more land and then we took your children and then we tried to make your language and we tried to eliminate your language that God gave you, and the Creator gave you. We didn’t respect you, we polluted your Earth, we’ve hurt you in so many ways but we’ve come to say that we are sorry. We are at your service and we beg for your forgiveness." This was a historically symbolic gesture forgiving centuries of oppression against Natives and honoring their partnership in defending the land from the Dakota Access Pipeline. Chief Leonard Crow Dog offered forgiveness and urged for world peace, responding that “we do not own the land, the land owns us.”

Johan Eliasch is finding himself in the news a lot these days. Just over a week ago it emerged that this Swedish-born tycoon ... had bought 400,000 acres of the Amazonian rainforest, an area the size of Greater London. He bought it, he said, to save it, to preserve its plants and wildlife - and, by preserving old-growth forest, to do his bit towards counteracting rising CO2 levels. Eliasch's response to the issue of global warming and the devastation of habitats is unusual, but it is not isolated. Paul van Klissingen, owner of Calor gas, has spent £15m on land in Africa. Kris McDivitt, former head of Patagonia clothing, and her husband Doug Tompkins, co-founder of the North Face, own 2m acres in Chile and Argentina. George Soros and Luciano Benetton own 1m and 2m acres of South America respectively. The idea is to step in where local governments, for whatever reason, have failed, or have more pressing issues to deal with, to buy up the land and lock it down by banning logging, sometimes establishing wildlife parks. Eliasch has been thinking about environmental issues for a long time, he says. When he was growing up in Stockholm he used to be able to walk out of his front door and ski from late October until April. "Today in Stockholm, you can't ski at all." A man who was paralyzed from the neck down can now operate his wheelchair and hug his family. Kristopher Boesen, who became paralyzed after a car crash, has become the first person in California to receive an experimental treatment made from stem cells. It has allowed him to use his arms and hands once again. The treatment is an injection that consists of 10 million AST-OPC1 cells, which are derived from embryonic stem cells. AST-OPC1 helps support the healthy functioning of nerve cells. In early April, a team at Keck Medical Center injected the treatment into Boesen’s damaged cervical spine. Three months later, he was able to do tasks like write his name. “I couldn’t drink, I couldn’t feed myself. I couldn’t text or, pretty much, do anything. I was basically just existing ... I wasn’t really living my life” Boesen [said]. “And now, after the stem cell surgery, I’m able to live my life.” Boesen’s success stems from strength. Just before his twenty-first birthday, Boesen lost control of his car [and] hit a tree ... leaving him with severe injuries to his spine. His parents were told he’d be paralyzed from the neck down, but they were also told that he qualified for a clinical study that could help. To participate, Boesen had to give voice confirmation that he wanted to be part of the study. The problem was that at the time, Boesen was using a ventilator to breath, and was unable to speak. Through sheer desire ... Boesen weaned himself off the ventilator in five days - a process that usually takes patients three weeks to complete.

"Who’s this black guy trying to make friends with the Ku Klux Klan?” A raised eyebrow, a shake of the head. Such were the sentiments of Scott Shepherd, a former Klan grand dragon, when he first saw Daryl Davis, a piano-playing bluesman who travels the nation attempting to dispel racism from those who hate him most. It doesn’t often work, but over the decades Davis, like a man on a quixotic pilgrimage, has collected more than two dozen Klan robes from those who have disavowed white supremacy. His unlikely story unfolds in “Accidental Courtesy,” a documentary by Matt Ornstein that follows Davis on an odd and lively quest to Confederate monuments, Klansmen houses, boogie joints, churches and a hot dog stand. “How can you hate me when you don’t even know me?” Davis asks in the film, which opens in Los Angeles on Friday. “Throughout my life I have been looking for an answer to that.” The son of a foreign service officer, Davis spent part of his childhood overseas, far from the racism many African Americans learn early. His first encounter with bigotry came when he was a 10-year-old Cub Scout. Bottles and rocks were thrown at him as he marched in a parade. The bewildering incident was the seed of a mission that years later found him ... starting a conversation with Klan Imperial Wizard Roger Kelly. The two became close. When Kelly quit the Klan, he gave Davis his robe. Talking to Klansmen “has worked for me,” said Davis. “I don’t seek to convert them but if they spend time with me, they can’t hate me.”
