Eavesdropping Laws Mean That Turning On an Audio Recorder Could Send You to Prison

Christopher Drew is a 60-year-old artist and teacher who wears a gray ponytail and lives on the North Side [of Chicago]. Tiawanda Moore, 20, a former stripper, lives on the South Side and dreams of going back to school and starting a new life. About the only thing these strangers have in common is the prospect that by spring, they could each be sent to prison for up to 15 years. The crime they are accused of is eavesdropping. The authorities say that Mr. Drew and Ms. Moore audio-recorded their separate nonviolent encounters with Chicago police officers without the officers’ permission, a Class 1 felony in Illinois, which, along with Massachusetts and Oregon, has one of the country’s toughest, if rarely prosecuted, eavesdropping laws. “Before they arrested me for it,” Ms. Moore said, “I didn’t even know there was a law about eavesdropping. I wasn’t trying to sue anybody. I just wanted somebody to know what had happened to me.” Ms. Moore ... is accused of using her Blackberry to record two Internal Affairs investigators who spoke to her inside Police Headquarters while she filed a sexual harassment complaint last August against another police officer. Mr. Drew was charged with using a digital recorder to capture his Dec. 2, 2009, arrest for selling art without a permit on North State Street in the Loop. Both cases illustrate the increasingly busy and confusing intersection of technology and the law, public space and private.

Undercover police cleared 'to have sex with activists'

Undercover police officers routinely adopted a tactic of "promiscuity" with the blessing of senior commanders, according to a former agent who worked in a secretive unit of the Metropolitan police for four years. The former undercover policeman claims that sexual relationships with activists were sanctioned for both men and women officers infiltrating anarchist, leftwing and environmental groups. Sex was a tool to help officers blend in, the officer claimed, and was widely used as a technique to glean intelligence. He said undercover officers, particularly those infiltrating environmental and leftwing groups, viewed having sex with a large number of partners "as part of the job". His comments contradict claims last week from the Association of Chief Police Officers that operatives were absolutely forbidden to sleep with activists. The claims follow the unmasking of undercover PC Mark Kennedy, who had sexual relationships with several women during the seven years he spent infiltrating a ring of environmental activists. Another two covert officers have been named in the past fortnight who also had sex with the protesters they were sent to spy on, fuelling allegations that senior officers had authorised sleeping around as a legitimate means of gathering intelligence.

'Prince of Mercenaries' who wreaked havoc in Iraq turns up in Somalia

Erik Prince, the American founder of the private security firm Blackwater Worldwide, has cropped up at the centre of a controversial scheme to establish a new mercenary force to crack down on piracy ... in the war-torn East African country of Somalia. The project, which emerged yesterday when an intelligence report was leaked to media in the United States, requires Mr Prince to help train a private army of 2,000 Somali troops that will be loyal to the country's United Nations-backed government. Several neighbouring states, including the United Arab Emirates, will pay the bills. Mr Prince is working in Somalia alongside Saracen International, a murky South African firm which is run by a former officer from the Civil Co-operation Bureau, an apartheid-era force notorious for killing opponents of the white minority government. News of his latest project has alarmed, though hardly surprised, critics of Blackwater. The firm made hundreds of millions of dollars from the "war on terror", but was severely tarnished by a string of incidents in post-invasion Iraq, in which its employees were accused of committing dozens of unlawful killings. Mr Prince ... remains entangled in a string of lawsuits pertaining to the alleged recklessness of the firm. For most of the past year, he has been living in Abu Dhabi, where he has close relations with the government and feels better positioned to dodge lawsuits.

Rethinking the OSS and CIA

It doesn't seem all that long ago that *le tout Washington* was crying for the CIA to be demolished and replaced by an updated version of the OSS, our World War II spying and dirty tricks service. The idea, accelerated by the Sept. 11, 2001, attacks, was that the CIA had grown too bloated, comfortable and cautious over the 40 years since it moved into its new headquarters in Langley, Va. The challenge thrown down by al-Qaeda, it was said, called for a far smaller, nimble, can-do organization, as presidential candidate John McCain put it, that would fight terrorist subversion across the world and in cyberspace. But a few hours spent with Douglas Waller's forthcoming and lively new book, Wild Bill Donovan: The Spymaster Who Created the OSS and Modern American Espionage, should cure that. As Waller and a number of other authors before him have discovered, the forerunner of the CIA was every bit as bewitched, beleaguered and befogged for much of its brief existence as [the CIA]. Even in Waller's balanced hands, there's no glossing over the record that the OSS's contribution to the glorious victories over Germany, and especially Japan, was marginal. From the invasion of North Africa through the Italian campaign, to the invasion of occupied France and the final push into Germany, the OSS mostly muddled through.

Feds checking post-vaccine seizures in young kids

Government officials are investigating an apparent increase in fever-related seizures in young children after they got a flu shot. The U.S. Food and Drug Administration on [January 20] said there have been 36 confirmed reports of seizures this flu season in children ages 6 months through 2 years. The seizures occurred within one day after they were vaccinated with Fluzone, the only flu shot recommended in the United States for infants and very young children. Ten of the children were hospitalized, but all recovered. The FDA said it is investigating to see if there is any connection between the vaccine and the seizures, or if something else caused the convulsions. The fever-related seizures — called febrile seizures — are convulsions brought on by a fever in infants or small children. A child often loses consciousness and shakes. Most seizures last a minute or two, and often children quickly recover. Such seizures may occur with any common childhood illnesses that may cause fever, such as ear infections, colds, influenza and other viral infections.

AT&T Case Asks High Court to Assign Privacy Rights to Companies

A business privacy case that comes before the U.S. Supreme Court today may rekindle a debate among the justices over whether corporations are like people, even to the point of suffering embarrassment. The case ... pits the Obama administration against AT&T Inc. over the release of documents stemming from a government investigation of the company. The question is whether corporations can invoke a Freedom of Information Act provision that protects against invasions of “personal privacy.” In siding with AT&T, a lower court said companies can be embarrassed and stigmatized just like human beings -- a contention the Obama administration scoffed at. The court’s divisions were on display when it considered whether to overturn decades-old restrictions on corporate campaign spending. During arguments in 2009, Justice Sonia Sotomayor said that judges “created corporations as persons” and that they might have been wrong to have “imbued a creature of state law with human characteristics.” Justice Ruth Bader Ginsburg said that “a corporation, after all, is not endowed by its creator with inalienable rights.” The court majority disagreed, ruling in a 5-4 decision that corporations have the same constitutional right to spend money on campaign ads as individuals do.

Plain-clothes officers 'were deployed at G20 demo'

Scotland Yard has admitted giving MPs inaccurate information by denying "covert officers" were deployed at London's G20 protests in April 2009. In a statement, the Metropolitan Police said it had established that covert officers had been deployed to the protests. The letter came after ... the unmasking of undercover policeman Mark Kennedy, who attended many demonstrations during seven years living as a spy among green activists. Giving evidence at the select committee in 2009, Commander Bob Broadhurst told MPs then: "The only officers we deploy for intelligence purposes at public order are forward intelligence team officers who are wearing full police uniforms with a yellow jacket with blue shoulders. There were no plain clothes officers deployed at all." The Met statement released on Wednesday said: "Having made thorough checks on the back of recent media reporting we have now established that covert officers were deployed during the G20 protests. Therefore the information that was given by Commander Bob Broadhurst to the Home Affairs Select Committee saying that 'We had no plain-clothes officers deployed within the crowd' was not accurate."

Vatican Told Irish Bishops Not to Report Abuse

A newly revealed 1997 letter from the Vatican warned Ireland's Catholic bishops not to report all suspected child-abuse cases to police — a disclosure that victims groups described as "the smoking gun" needed to show that the Vatican enforced a worldwide culture of cover-up. The letter, obtained by Irish broadcasters RTE and provided to The Associated Press, documents the Vatican's rejection of a 1996 Irish church initiative to begin helping police identify pedophile priests following Ireland's first wave of publicly disclosed lawsuits. Child-abuse activists in Ireland said the 1997 letter should demonstrate, once and for all, that the protection of pedophile priests from criminal investigation was not only sanctioned by Vatican leaders but ordered by them. "The letter is of huge international significance, because it shows that the Vatican's intention is to prevent reporting of abuse to criminal authorities. And if that instruction applied here, it applied everywhere," said Colm O'Gorman, director of the Irish chapter of human rights watchdog Amnesty International. The Vatican does advise bishops worldwide to report crimes to police — in a legally nonbinding lay guide on its Web site. This recourse is omitted from the official legal advice provided by the Congregation for the Doctrine of the Faith and updated last summer. That powerful policymaking body continues to stress the secrecy of canon law.

An Assassination’s Long Shadow

Today, millions of people on another continent are observing the 50th anniversary of an event few Americans remember, the assassination of Patrice Lumumba. The 35-year-old Lumumba was the first democratically chosen leader of the ... Democratic Republic of Congo. Thousands of Belgian officials who lingered on did their best to sabotage things: their code word for Lumumba in military radio transmissions was “Satan.” Shortly after he took office as prime minister, the C.I.A., with White House approval, ordered his assassination and dispatched an undercover agent with poison. The would-be poisoners could not get close enough to Lumumba to do the job, so instead the United States and Belgium covertly funneled cash and aid to rival politicians who seized power and arrested the prime minister. On Jan. 17, 1961, after being beaten and tortured, he was shot. Stephen R. Weissman, a former staff director of the House Subcommittee on Africa, recently pointed out that Lumumba’s violent end foreshadowed today’s American practice of “extraordinary rendition.” The Congolese politicians who planned Lumumba’s murder checked all their major moves with their Belgian and American backers, and the local C.I.A. station chief made no objection when they told him they were going to turn Lumumba over — render him, in today’s parlance — to the breakaway government of Katanga, which, everyone knew, could be counted on to kill him.

Julian Assange, the WikiLeaks founder, today pledged to make public the confidential tax details of 2,000 wealthy and prominent individuals, after being passed the data by a Swiss banker who claims the information potentially reveals instances of money-laundering and large-scale illegal tax evasion. Rudolf Elmer, formerly a senior executive at the Swiss bank Julius Baer, based in the Cayman islands, said he was handing the data to WikiLeaks as part of an attempt "to educate society" about the amount of potential tax revenues lost thanks to offshore schemes and money-laundering. "As [a] banker, I have the right to stand up if something is wrong," he said. "I am against the system. I know how the system works and I know the day-to-day business. I want to let society know how this system works because it's damaging our society," he said. Elmer will appear in a Swiss court on Wednesday charged with breaking Swiss banking secrecy laws, forging documents and sending threatening messages to two officials at his former employer. He denies the charges. Assange ... said he would pass the information to the Serious Fraud Office(SFO), examine it to ensure sources were protected, and then release it on the WikiLeaks site, potentially within "a couple of weeks".

Behind Dimona’s barbed wire ... Israel has spun nuclear centrifuges virtually identical to Iran’s at Natanz, where Iranian scientists are struggling to enrich uranium. Dimona tested the effectiveness of the Stuxnet computer worm, a destructive program that appears to have wiped out roughly a fifth of Iran’s nuclear centrifuges and helped delay, though not destroy, Tehran’s ability to make its first nuclear arms. The operations [at Dimona], as well as related efforts in the United States, are among the newest and strongest clues suggesting that the virus was designed as an American-Israeli project to sabotage the Iranian program. Bhutan has pioneered the use of Gross National Happiness (GNH) as a measure of progress, instead of the more commonly used GNP. GNH measures not only economic activity, but also cultural, ecological, and spiritual well-being. In September 2010, Bhutanese Prime Minister Jigmi Y. Thinley visited the United States to promote GNH education and economic theory. Prakash: What difference has it made to have GNH as your yardstick rather than gross domestic product? Thinley: First, we are promoting sustainable and equitable socioeconomic development which can be measured to a larger extent through conventional metrics. Second is the conservation of a fragile ecology, [using] indicators of achievement, [such] as the way the [vegetation] cover in my country has expanded over the last 25 years from below 60 to over 72 percent. The third strategy is promotion of culture, which includes preservation of the various aspects of our culture that continue to be relevant and supportive of Bhutan’s purpose as a human civilization. No Bhutanese should suffer a sense of insecurity arising from loss of their cultural identity, language, and so on, under the onslaught of modernization. Then there is the fourth strategy—good governance—on which the other three strategies or indicators depend. We know that democracy is the best form of governance.

Interrogating the Arizona Killings from a Safe Distance

Governments (ab)use their authority to treat awkward knowledge as a matter of state secrets, and criminalise those who are brave enough to believe that the citizenry needs to know the crimes that their government is committing with their trust and their tax dollars. The arguments swirling around the 9/11 attacks are emblematic of these issues. What fuels suspicions of conspiracy is the reluctance to address the sort of awkward gaps and contradictions in the official explanations that [WantToKnow team member] David Ray Griffin (and other devoted scholars of high integrity) have been documenting in book after book ever since his authoritative The New Pearl Harbor in 2004 (updated in 2008). This brings me to the Arizona shootings. The most insistent immediate responses have come from the opposite ends of the political spectrum, both proceeding on presuppositions rather than awaiting evidence. If we want to be responsible in our assessments, we must restrain our political predispositions, and obtain the evidence. Let us remember that what seems most disturbing about the 9/11 controversy is the widespread aversion of government and media to the evidence that suggests, at the very least, the need for an independent investigation that proceeds with no holds barred.

First dead birds, then dead fish ... now crickets

A virus has killed millions of crickets raised to feed pet reptiles and those kept in zoos. The cricket paralysis virus has disrupted supplies to pet shops across North America as a handful of operators have seen millions of their insects killed. Some operations have gone bankrupt and others have closed indefinitely until they can rid their facilities of the virus. Cricket farms started in the 1940s as a source of fish bait, but the bulk of sales now are to pet supply companies, reptile owners and zoos, although people also eat some. Most U.S. farms are in the South, but suppliers from Pennsylvania to California also raise crickets. The virus had swept through European cricket farms in 2002. It was first noticed in 2009 in the U.S. and Canada. The virus marks the latest in a recent series of mass animal deaths. Blackbirds fell out of the sky on New Year's Eve in Arkansas. In the days that followed, 2 million fish died in the Chesapeake Bay, 150 tons of red tilapia in Vietnam, 40,000 crabs in Britain and other places across the world. In the past eight months, the U.S. Geological Survey's National Wildlife Health Center has logged 95 mass wildlife die-offs in North America and that's probably a dramatic undercount, officials say.

The state's pedlars of fear must be brought to account

[Mark] Kennedy moved from undercover agent to agent provocateur. He worked for a murky organisation called the National Public Order Intelligence Unit (NPOIU). With a budget of £5m this operates as a branch of the National Domestic Extremism Unit (NDEU) which, in turn, works alongside the National Extremism Tactical Co-ordination Unit (NETCU). Ask where this stands, and you will be told it reports to the Association of Chief Police Officers' Terrorism and Allied Matters Committee, codenamed Acpo(TAM). Kennedy's bosses in the NPOIU work for Acpo, but this is not what it seems. It is not, as its name suggests, the police officers' staff club, nor is it a public body of any sort. [ACPO] is a private company, incorporated in 1997. It is sub-contracted by Whitehall to operate the police end of the government's counterterrorism and "anti-extremism" strategies. It is thus alongside MI5, but even less accountable. It now runs its own police forces under a police chief boss, Sir Hugh Orde, like a British FBI. It trades on its own account, generating revenue by selling data from the police national computer for £70 an item (cost of retrieval, 60p). It owns an estate of 80 flats in central London. As a private company, Acpo need not accede to Freedom of Information requests and presumably could distribute its profit to its own board. The whole operation is reminiscent of the deals set up by the Pentagon with private firms to run the Iraq and Afghan wars, free of publicity or accountability.

Icelandic MP fights US demand for her Twitter account details

A member of parliament in Iceland who is also a former WikiLeaks volunteer says the US justice department has ordered Twitter to hand over her private messages. Birgitta Jonsdottir, an MP for the Movement in Iceland, said last night on Twitter that the "USA government wants to know about all my tweets and more since november 1st 2009. Do they realize I am a member of parliament in Iceland?" She said she was starting a legal fight to stop the US getting hold of her messages, after being told by Twitter that a subpoena had been issued. She added that the US authorities had requested personal information from Twitter as well as her private messages and that she was now assessing her legal position. "It's not just about my information. It's a warning for anyone who had anything to do with WikiLeaks. It is completely unacceptable for the US justice department to flex its muscles like this. I am lucky, I'm a representative in parliament. But what of other people? It's my duty to do whatever I can to stop this abuse."

Under Siege in War-Torn Somalia, a Doctor Holds Her Ground

Somalia has been at war with itself for 20 years. The health care system, like much of the country, has been demolished. There are very few functioning hospitals left. But for decades — as the government imploded, warlords took over, more warlords came and an Islamist insurgency swept across Somalia — Dr. [Hawa] Abdi has persevered, offering a refuge for thousands of families driven from their homes by relentless street battles. In a nation where the government controls only a few blocks in this war-torn capital, Dr. Abdi and her daughters, who are also doctors, are essentially running a small, desperate city on their own. But that is not enough, in her estimation. So, on separate patches of land she owns, she is organizing families to run farms and has bought a small fleet of fishing boats to help feed the camp. Her stubborn commitment has earned her recognition worldwide. Eliza Griswold, who wrote about the compound in her book The Tenth Parallel, said, “Mostly out of sheer moxie, Dr. Hawa and her daughters have built a city of healing within the war’s brutal chaos.” Dr. Abdi’s daughter Amina, who first learned to practice medicine trudging behind her mother during visits to the bush, said her mother needed to rest. “But she has never rested in 20 years,” Amina laughed.

U.S. says too much fluoride in water

Fluoride in drinking water — credited with dramatically cutting cavities and tooth decay — may now be too much of a good thing. Getting too much of it causes spots on some kids' teeth. A reported increase in the spotting problem is one reason the federal government will announce [that] it plans to lower the recommended levels for fluoride in water supplies — the first such change in nearly 50 years. About 2 out of 5 adolescents have tooth streaking or spottiness because of too much fluoride, a surprising government study found recently. In some extreme cases, teeth can even be pitted by the mineral. Maryland is the most fluoridated state, with nearly every resident on a fluoridated water system. In contrast, only about 11% of Hawaii residents are on fluoridated water, according to government statistics. Fluoridation has been fought for decades by people who worried about its effects, including conspiracy theorists who feared it was a plot to make people submissive to government power. "It's amazing that people have been so convinced that this is an OK thing to do," said Deborah Catrow, who successfully fought a ballot proposal in 2005 that would have added fluoride to drinking water in Springfield, Ohio.

US foreclosures in new legal trouble

Two of the US's biggest mortgage lenders have had mortgage foreclosures cancelled in a case that could affect other banks. The Supreme Court in Massachusetts ruled against US Bancorp and Wells Fargo in a widely watched case. Backing a lower court ruling made in 2009, it said two foreclosure sales were invalid because the banks did not prove that they owned them at the time. The decision is among the earliest to address the validity of foreclosures done without proper documentation - so-called robo-loans because they were carried out by people who were unqualified and who often did not check a single line in the paperwork. Marty Mosby, an analyst at Guggenheim Securities said: "A ruling like this will slow down the foreclosure process. They're going to have to be really precise and get everything in order. When people consider the connections between drugs and violence, what typically comes to mind are illegal drugs like crack cocaine. However, certain medications — most notably, some antidepressants like Prozac — have also been linked to increase risk for violent, even homicidal behavior. A new study from the Institute for Safe Medication Practices published in the journal PloS One and based on data from the FDA's Adverse Event Reporting System has identified 31 drugs that are disproportionately linked with reports of violent behavior towards others. Please note that this does not necessarily mean that these drugs cause violent behavior. Nonetheless, when one particular drug in a class of nonaddictive drugs used to treat the same problem stands out, that suggests caution: unless the drug is being used to treat radically different groups of people, that drug may actually be the problem.
