Federal agent John Dodson says what he was asked to do was beyond belief. He was intentionally letting guns go to Mexico. An Alcohol, Tobacco and Firearms [ATF] senior agent assigned to the Phoenix office in 2010, Dodson's job is to stop gun trafficking across the border. Instead, he says he was ordered to sit by and watch it happen. Investigators call the tactic letting guns "walk." In this case, walking into the hands of criminals who would use them in Mexico and the United States. Dodson's bosses say that never happened. Agent Dodson and other sources say the gun walking strategy was approved all the way up to the Justice Department. The idea was to see where the guns ended up, build a big case and take down a cartel. And it was all kept secret from Mexico. ATF named the case "Fast and Furious." Documents show the inevitable result: The guns that ATF let go began showing up at crime scenes in Mexico. And as ATF stood by watching thousands of weapons hit the streets. The Fast and Furious group supervisor noted the escalating Mexican violence. One e-mail noted, "958 killed in March 2010 ... most violent month since 2005." Dodson feels that ATF was partly to blame for the escalating violence. Senior agents including Dodson ... confronted their supervisors over and over. Their answer ... "If you're going to make an omelette, you've got to break some eggs." On Dec. 14, 2010, Border Patrol Agent Brian Terry was gunned down. Two assault rifles ATF had let go nearly a year before were found at Terry's murder. Dodson said, "I felt guilty. I mean it's crushing." Dodson said they never did take down a drug cartel. However, he said thousands of Fast and Furious weapons are still out there and will be claiming victims on both sides of the border for years to come.

Project Gunrunner [was] a nationwide initiative launched in Laredo, Texas, in 2005, which sought to reduce the smuggling of firearms across the U.S. southern border. But while the primary tactic of Gunrunner was the interdiction of buyers and sellers who were violating the laws, [ATF] agents in Phoenix had other plans. They wanted to see where the guns went if they were allowed to cross the border — to follow the small fish until they caught bigger ones. Agents named their operation “Fast and Furious,” after the popular movie about car racing. Between September 2009 and December 2010, a joint task force comprised of federal officials from ATF, FBI, DEA, and ICE, working under the U.S. Attorney’s Office for the District of Arizona, let over two thousand guns “walk” to Mexico. The murder that made the flawed operation public and political in the United States was of an American citizen on US soil: the killing of US Border Patrol agent Brian Terry. Though the investigators could not identify the specific gun that fired the bullet, two AK-47 style WASR-10 rifles were recovered at the scene. I sued after it was clear the Department of Justice would not hold their own accountable. The case is the first we know of in which a journalist spied on by the government received a clerk’s default against an agent working for government parties in a surveillance operation. It’s a small victory because he was soon reported dead, which means we can’t access potential information leading to the larger players. Besides that, I’ve learned that wrongdoers in the federal government have their own shield laws that protect them from accountability. Our intelligence agencies have been working hand in hand with the telecommunications firms for decades, with billions of dollars in dark contracts and secretive arrangements. They don’t need to ask the telecommuncations firms for permission to access journalists’ records, or those of Congress or regular citizens.

A federal agent who exposed the Justice Departments flawed gun-trafficking investigation known as Operation Fast and Furious says the FBI played a key role in events leading to the 2010 murder near Nogales, Ariz., of U.S. Border Patrol Agent Brian Terry. John Dodson, a special agent with the Bureau of Alcohol, Tobacco, Firearms and Explosives, contends that the bandits who killed Terry were working for FBI operatives and were sent to the border to do a drug rip-off using intelligence from the federal Drug Enforcement Administration. I dont think the (FBI) assets were part of the rip-off crew, Dodson said. I think they were directing the rip crew. Dodsons comments to The Arizona Republic amplify assertions he made in his recently released book, The Unarmed Truth, about his role as a whistle-blower in the Fast and Furious debacle. In his book, Dodson uses cautious language to characterize his account of circumstances surrounding Terrys death, saying the information is based on firsthand knowledge, personal opinion and press reports. He asserts that the DEA had information about, and may have orchestrated, a large drug shipment through Peck Canyon that December night. He alleges that DEA agents shared that intelligence with FBI counterparts, who advised criminal informants from another cartel that the load would be theirs for the taking. Stealing such a shipment would increase the clout of the FBI informants in the cartel organization they had penetrated, Dodson wrote, and thus lead to better intel for them in the future.

A Republican-run House committee voted today to cite Attorney General Eric Holder for contempt after President Obama asserted executive privilege over documents in the "Fast and Furious" operation. The "decision to invoke executive privilege implies that White House officials were either involved in the Fast and Furious operation or the cover-up that followed," said Michael Steel, a spokesman for House Speaker John Boehner, R-Ohio. "The administration has always insisted that wasn't the case. Agents involved in Operation Fast and Furious lost track of some weapons. Two guns were later found at the scene of the killing of a U.S. border patrol agent, Brian Terry. In a statement issue by their attorney, Terry's parents condemned the Obama administration for invoking executive privilege. "Our son, Border Patrol Agent Brian Terry, was killed by members of a Mexican drug cartel armed with weapons from this failed Justice Department gun trafficking investigation," said Josephine Terry and Kent Terry Sr. "For more than 18 months we have been asking our federal government for justice and accountability." The Terrys also said that "our son lost his life protecting this nation, and it is very disappointing that we are now faced with an administration that seems more concerned with protecting themselves rather than revealing the truth behind Operation Fast and Furious." The investigation into the operation was spurred after Sen. Charles Grassley, R-Iowa, inquired into whistle-blower allegations that the government had allowed the transfer of illegally purchased weapons.

South of El Paso, Texas, on Mexico's side of the border, lies Juarez - the most dangerous city in the world. ATF [U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives] Special Agent Rene Jaquez has been stationed there for the past year, trying to keep U.S. guns from being trafficked into Mexico. "That's what we do as an agency," Jaquez said. "ATF's primary mission is to make sure that we curtail gun trafficking." That's why Jaquez tells CBS News he was so alarmed to hear his own agency may have done the opposite: encouraged U.S. gun dealers to sell to suspected traffickers for Mexico's drug cartels. Apparently, ATF hoped that letting weapons "walk" onto the street - to see where they'd end up - would help them take down a cartel. Jaquez is so opposed to the strategy, he's speaking out. "You don't let guns walk. I've never let a gun walk." Yet ATF agents told us they were ordered to let thousands of weapons walk. But ATF wasn't working alone on the case known as "Fast and Furious." Documents show ATF had conference calls with "DHS" (Homeland Security). "USMS" (U.S. Marshals) and DEA. An "ICE," or Customs agent, was on ATF's Fast and Furious team. They were advised by an "AUSA," or Assistant U.S. Attorney under the Justice Department. Jaquez says he's left wondering whether runaway violence in Mexico can be partly blamed on the agency tasked with stopping it.

North of the border, the .50-caliber sniper rifle is the stuff of YouTube celebrity. It is among the most destructive weapons legally available in the United States. But every week, those rifles are trafficked across the border to Mexico. After years of failed U.S. and Mexican efforts to curb arms trafficking, groups such as the Jalisco New Generation and Sinaloa cartels are showcasing the military-grade weapons in slick propaganda videos and using them to defeat security forces in battle. Roughly 2.5 million illicit American guns have poured across the border in the past decade, according to a new Mexican government study. The cartels are using trafficked weapons to kill record numbers of police officers — 464 in the first nine months of 2020 alone — and smaller armed groups are fueling historically high homicide rates. Mexican officials, in rare public criticism, are now venting their frustration at what they say is the U.S. failure to stop the flow of .50-caliber rifles. At a time when the United States is pushing Mexico to target cartels more aggressively, U.S. laws that make .50-calibers and other destructive weapons easy to buy ... are enabling those groups to expand their influence and activities in the country. “El Flaco” ... works as a mercenary, he said, and had come to discuss a closely guarded secret of Mexico’s most powerful cartels: The FGM 148 Javelin infrared-guided, missile launcher. El Flaco maintains he has been trained to perform special operations using shoulder-fired weapons, including the Javelin. He said he now trains others to use it as well. If El Flaco is telling the truth, Javelins would be among the most extreme examples of the escalation in the arms race between cartels and Mexican military. Cartels’ arsenals now include belt-fed gatling guns, drone bombs and land mines. The U.S.-made Javelin is the most sophisticated shoulder-fired missile launcher in the world, with a range of a mile and a half. Its main purpose is to destroy military tanks, but it also has the capacity to take down low-flying helicopters. There are holes in the U.S. tracking system. During the Iraq War in 2003, the department lost track of 35 Javelins provided to Iraqi allied forces. ISIS was found to have a Javelin in Syria, Kurdish fighters there also obtained a Javelin and the weapon was found at a Libyan warlord base. Since 2018, the Mexican government has reported seizing a dozen rocket launchers and 56 grenade launchers from cartels. Thomas Brandon with the U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives said it was clear that “criminal organizations and drug cartels based in Mexico continue to look towards the United States as a source of supply for firearms and in this case military grade weapons such as grenades, machine guns, and Man-Portable Air Defense.”

Pulling a pistol from his waistband, the young man spun his human shield toward police. “Don’t do it!” a pursuing officer pleaded. The young man complied, releasing the bystander and tossing the gun. Police ... soon learned that the 9mm Beretta had a rap sheet. Bullet casings linked it to four shootings. The pistol was U.S. Army property. The Army couldn’t say how its Beretta M9 got to New York’s capital. Until the June 2018 police foot chase, the Army didn’t even realize someone had stolen the gun. Inventory records checked by investigators said the M9 was 600 miles away - safe inside Fort Bragg, North Carolina. In the first public accounting of its kind in decades, an Associated Press investigation has found that at least 1,900 U.S. military firearms were lost or stolen during the 2010s, with some resurfacing in violent crimes. AP’s total is a certain undercount. Government records covering the Army, Marine Corps, Navy and Air Force show pistols, machine guns, shotguns and automatic assault rifles have vanished from armories, supply warehouses, Navy warships, firing ranges and other places where they were used, stored or transported. These weapons of war disappeared because of unlocked doors, sleeping troops, a surveillance system that didn’t record, break-ins and other security lapses that, until now, have not been publicly reported. The Army sought to suppress information on missing weapons and gave misleading numbers that contradict internal memos.

Members of a congressional committee at a public hearing Wednesday blasted former President Barack Obama and his attorney general for allegedly covering up an investigation into the death of a Border Patrol agent killed as a result of a botched government gun-running project known as Operation Fast and Furious. The House Oversight Committee also Wednesday released a scathing, nearly 300-page report that found Holders Justice Department tried to hide the facts. Terry died in a gunfight. [His] death exposed Operation Fast and Furious, a Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) operation in which the federal government allowed criminals to buy guns in Phoenix-area shops with the intention of tracking them as they were transported into Mexico. But the agency lost track of more than 1,400 of the 2,000 guns they allowed smugglers to buy. Two of those guns were found at the scene of Terry's killing. Sen. Charles Grassley, R-Iowa, testified Wednesday in front of the committee, accusing DOJ and ATF officials of obstructing the investigation and working to silence ATF agents who informed the Senate of Fast and Furious. One of those silenced ATF agents, John Dodson, testified Wednesday that he remains in a state of purgatory since objecting to Fast and Furious and has been the subject of reprisals. The Obama administration has ruled that inspectors general have to get permission from the agency theyre monitoring for access to wiretaps, grand jury and credit information, a decision that immediately was denounced by watchdogs and lawmakers. The Justice Departments inspector general said the 58-page ruling ... will undermine his ability to do his job rooting out fraud and corruption. Without such access, our offices ability to conduct its work will be significantly impaired, Inspector General Michael E. Horowitz said in a statement. His disapproval was followed by a bipartisan condemnation from four congressional leaders whose committees have oversight over DOJ. [In] 2010 ... the FBI started restricting the DOJ inspector generals access to documents whose confidentiality is protected by law, including grand jury testimony and wiretaps. The IGs review of the controversial Fast and Furious case, the failed sting operation that lost track of more than 1,000 government-issued guns, one of which was used to kill a U.S. Border Patrol agent, was delayed. Other investigations have lagged, Horowitz testified before Congress last February, complaining that the FBI has failed to turn over key records in several whistleblower cases. The renowned correspondent [Sharyl Attkisson] recently bolted CBS News after prolonged turmoil and tensions over her work and how it fit with a mainstream broadcast network. Attkisson pushed super-hard on stories that painted the Obama administration in a bad light, including coverage of the Fast & Furious gun-interdiction program and Benghazi. She also covered aviation, Obamacare and other [issues]. She worked at the network for two decades. In a chat today with Attkisson, [radio host Chris Stigall on Philadelphia station WPHT] wisely picked up on the question of air time. He asked whether CBS News had instructed Attkisson to knock it off with her anti-Obama stories and denied her exposure for such fare. The response from Attkisson was ... damning: "With various stories, you do get the idea at some point that they want you to stop, especially if you start to dig down right into something very, very important, and its not just with political stories its with stories that go after other interests, corporations, different things. There seems to come a point when you get close, they seem to not be interested in the stories anymore sometimes and some people ... or some managers act as though, yes, youre a problem if you keep pursuing the questions." She had blockbuster scoops perhaps many of them that her bosses all but killed. "Why be at a place where ... youve never been better positioned to break original investigative stories but have nothing that you can do with them once you do so. Thats sort of the position I felt I was in.

Rep. Lamar Smith, chairman of the House Judiciary Committee, ... demanded an independent investigation of whether Attorney General Eric Holder misled Congress on what he knew about the botched gun-tracking operation known as "Fast and Furious" - and when he found out about it. The Associated Press reported that the George W. Bush administration conducted a program similar to Fast and Furious, in which Bureau of Alcohol, Tobacco, Firearms and Explosives agents were instructed to let Mexican drug cartel straw purchasers buy guns in the Phoenix area to follow the trail to higher-ups. Known as Operation Wide Receiver, the Bush-era operation also let guns be transferred to suspected arms traffickers. Justice Department prosecutors have brought charges against nine people involved in the operation, according to AP; two have pleaded guilty. Fast and Furious was meant to take down Mexican cartels importing U.S.-bought weapons and shipping drugs to the United States. Phoenix-based ATF agents allowed the gun purchases so they could take down cartel bosses rather than only arresting lower-level purchasers. But the agents lost track of more than 1,000 firearms during the operation last year. Several were later found at the scenes of Mexican drug crimes, according to a report by the House oversight committee.

Two years ago, federal agent John Dodson turned whistleblower and exposed a botched gun operation in Phoenix that led to senior-level resignations, 18 months of congressional investigations and the first vote in history by the House to hold a sitting attorney general in contempt of Congress. Now, the Bureau of Alcohol, Tobacco, Firearms and Explosives, where Dodson works, is preventing him from publishing a book about the failed gun investigation, dubbed Fast and Furious, because the agency says it would hurt morale at the agency. The American Civil Liberties Union came to Dodsons defense [on October 7] and filed a protest with the ATF, strongly objecting to the agencys efforts to block Dodson from publishing his book, which has been written, saying the decision violates his constitutional protections. Sen. Charles E. Grassley (R-Iowa) and Rep. Darrell Issa (R-Calif.), two persistent critics of the ATF, wrote a foreword for the book. This isnt the first time somebody from the ATF or another government agency has written a book, Grassley said. Just because the ATF leadership doesnt like the content of the book doesnt mean they should be able to prevent the author from giving his side of the story. During the gun-trafficking operation run by Phoenix special agents between late 2009 and early 2011, the ATF lost track of more than 2,000 guns that investigators were monitoring as they were sold to traffickers suspected of arming Mexican drug cartels. The operation to link guns to a cartel fell apart after two of the guns being tracked were found at the scene of a shootout that killed U.S. Border Patrol Agent Brian Terry.

Rep. Darrell Issa [contends] that the Department of Justice in Washington and perhaps the Obama White House were aware of the flawed tactics in the ATFs Fast and Furious gun-tracking operation in Arizona that allowed more than 2,000 firearms to walk into the hands of Mexican drug cartels. A month before the operation was stopped, U.S. Border Patrol Agent Terry was killed in a December 2010 shootout and two Fast and Furious weapons were discovered at the crime scene between the Mexican border and Tucson. Scores of more weapons have been found at violent crimes in Mexico. Issa contends [that] wiretap documents, signed by top Justice officials in support of Fast and Furious, are proof that administration officials knew the tactics were flawed and should have stopped the operation long before the agent and others were killed. The tactics of Fast and Furious were known, he said. They were known and are contained in these wiretaps. Issa said he obtained the materials from a furious group of whistle-blowers who are angry with the Justice Department and Atty. Gen. Eric H. Holder Jr. for not providing more material to Issas investigation into Fast and Furious. The whistle-blowers, he told Holder at the hearing, are tired of your stonewalling.

Just a couple of months ago, we profiled Congressman Jason Chaffetz, the Republican chairman of the powerful House Oversight Committee which was poised to dig deep on wide-ranging investigations into government mischief, waste, fraud and abuse. A few weeks later, Chaffetz abruptly resigned from Congress. We asked the "Oversight Man" what changed his mind. "The reality is, sadly, I don't see much difference between the Trump administration and the Obama administration," [Chaffetz said]. "I thought ... these floodgates would open up with all the documents we wanted from the Department of State, the Department of Justice, the Pentagon. "We have everything from the Hillary Clinton email investigation, which is really one of the critical things. There was the investigation into the IRS. And one that was more than seven years old is Fast and Furious. We have been in court trying to pry those documents out of the Department of Justice and still to this day, they will not give us those documents. And at the State Department, nothing. Stone-cold silence."
